Limitation of Liability - System Physics, LLC

Effective Date: January 1, 2025

IMPORTANT: READ CAREFULLY BEFORE USING THE SERVICE

This Limitation of Liability Agreement ("Agreement") is entered into between you ("User") and System Physics, LLC, a Georgia limited liability company ("System Physics").

ACKNOWLEDGMENT OF RISKS

User acknowledges and understands that:

1. HUNTING ACTIVITIES ARE INHERENTLY DANGEROUS and involve significant risks including but not limited to:
- Serious bodily injury or death
- Property damage
- Getting lost in wilderness areas
- Adverse weather conditions
- Wildlife encounters
- Weapon-related accidents

2. TECHNOLOGY LIMITATIONS: The GameTrail.Science application provides predictions and recommendations based on artificial intelligence and available data, but:
- No predictions are guaranteed to be accurate
- Weather data may be outdated or incorrect
- AI analysis may contain errors
- Map information may be incomplete or inaccurate

3. USER RESPONSIBILITY: User is solely responsible for:
- All hunting decisions and activities
- Following all applicable laws and regulations
- Obtaining proper licenses and permits
- Ensuring personal safety and the safety of others
- Verifying all information independently

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

1. System Physics, LLC, its officers, directors, employees, agents, and affiliates SHALL NOT BE LIABLE for any injuries, damages, losses, or claims arising from or related to:
- Use of the GameTrail.Science application
- Hunting activities undertaken based on app recommendations
- Inaccurate predictions or recommendations
- Technical failures or service interruptions
- Reliance on weather data or mapping information

2. TOTAL LIABILITY CAP: System Physics's total liability for any claims shall not exceed the amount paid by User for the Service in the twelve (12) months preceding the claim.

3. EXCLUSION OF DAMAGES: System Physics shall not be liable for:
- Indirect, incidental, special, or consequential damages
- Lost profits or business opportunities
- Emotional distress or psychological harm
- Punitive or exemplary damages

ASSUMPTION OF RISK

User voluntarily assumes all risks associated with hunting activities and use of the Service. User agrees that System Physics provides guidance only and makes no warranties about hunting success, safety, or outcomes.

INDEMNIFICATION

User agrees to indemnify, defend, and hold harmless System Physics, LLC and its affiliates from any claims, damages, or expenses arising from User's hunting activities or use of the Service.

GOVERNING LAW AND JURISDICTION

This Agreement is governed by Georgia law. Any disputes shall be resolved exclusively in Georgia courts.

SEVERABILITY

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.

ACKNOWLEDGMENT

By using the GameTrail.Science service, User acknowledges having read, understood, and agreed to this Limitation of Liability Agreement.
